The delay accumulated by the general land survey system in totally solving the issue of the private land property throughout the national territory ; and the failure of the procedure of the « acte de notoriété » (notarial deed) in solving the problem of the private land ownership, whose implementation has encouraged the violation of real estate property in general, and has even affected the national land properties and the Waqf (religious) properties, thus increasing the judicial
cases ; have recently led the legislator to design a new system called « enquête foncière » (Land Inquiry) in order to replace the « acte de notoriété », and to adopt bill N° 07/02 dated 27 February 2007 enacting a procedure establishing the real estate property and issuing a property deed following an « enquête foncière » (Land Inquiry).
The executive decree N° 08/147 related to the operations of « enquête foncière » and issuance of a property deed defines the enforcement procedures of bill N° 07/02. The deed issued to the applicant for an « enquête foncière »
(Land Inquiry) in accordance with the rules and procedures defined by this bill is a property deed through possession issued to any person who owns a private real estate which is not part of the national properties or of the Waqf properties, and which is located on lands which have not been surveyed in the framework of the general cadastre.
