| Résumé : |
This research tends to determine the real objectives of constitutional council, through the anlysis of its constitutionnal organization or through the determination of its nature. This research contains two chapters; the first chapter deals with the study of constitutional council organization, that is, its members, structures, work procedures and different specifications. The second chapter deals with the study of the council nature and its juridical policy. These studies permit to verify the existence of a will in support of construction of democratic society with strong institutions made to complete each others, and undertake their activities under the respect of the constitution. This would be through the achievement of equilibrium between authorities and different specifications. The studies also show that the constitutional council is of constitutional juridical nature, on the European model, eventhough some weakness can be noted, wich could be overcome. Despite of this, the council plays a double role which consists in protecting constitutional principles and overcome the weakness observed in institutional rules. This leads to consider that the institution of a constitutional council in Algeria is an establishment which can be exploited as it is, and work for its improvement regarding the political and institutional reality development of the Algerian state, and regarding constitutional inovations our world knows today. |
