Résumé :	The sale or vaiver of the state’s real estate property , until it is a legal and lawful action but it poses a great danger because of it’s depletion and weakining of the public property balance, which is considered one of the most important means of acheiving plans and dévelopment programs in the country, whether political, economic, or social, it is also considered a non renewable gain due to limited space. So in ordre to protect and préserve it, the legislator has definded the sale of the system with a special and integrated legal system, both in terms of the provisions related to it or the administrative appartus that ensures its management or the judicial authorities competent to hear disputes related to it, and this is what we have addressed through this thesis.
